Simplexity Tech Singapore Pte Ltd (“the Company“), engages in business activities that contribute to society, while endeavoring to earn the trust of all stakeholders and meet the expectations of stakeholders.

The Company protects the Personal Information obtained from customers, suppliers and officers/employees of the Company, in the course of business activities appropriately in accordance with the following Basic Policy, recognizing that the Personal Information is an important asset of each stakeholder and also an important asset for the Company, leading to creation of new value.

1. Basic Policy

1. The Company strictly observes the “Personal Data Protection Act 2012” of Singapore and other relevant laws and regulations, as well as similar laws and regulations in the relevant countries and regions. The Company has established the Personal Information Protection Policy (the “Policy“), by which the Company steadily implements and maintains, while striving to continuously improve, the protection and management of the Personal Information.
2. The Company has established a management framework to protect the Personal Informationassigning a person in charge at each of its relevant divisions and ensures that all officers and employees recognize the importance of the Policy and comply with it.
3. The Company utilizes the Personal Information within the scope of the intended use that is clearly communicated to the individual to whom the Personal Information refers. The Company does not disclose or provide to third parties the Personal Information provided by customers, and officers/employees of the Company, except with the consent of the individual to whom the Personal Information refers or when there is a legal reason.
4. While maintaining the accuracy of and keeping updated the Personal Information, the Company strives to prevent unauthorized access to the Personal Information or the divulgence, loss, or damage of the Personal Information and continually enhances and remediates the information security management.
5. The Company responds to inquiries from the individuals concerning the Personal Information or requests from the individuals for disclosure of the Personal Information, sincerely and without delay.

2. Definition of Personal Information

“Personal Information” shall mean the information used for the business of the Company by which a specific person (including a person deceased in recent 10 years) can be identified because of the name, birth day, and other descriptions contained therein, and shall also include such information by which a specific person can be identified by collating it with other easily available information.  Personal Information does not include business contact information, which is typically the information shown on business/name cards and is not provided by the individual solely for his/her personal purposes.

3. Intended Use of Personal Information

With respect to the intended use of the Personal Information which the Company holds, please refer to the page of Intended Use of Personal Information.

When the Company obtains the Personal Information from customers, and officers/employees of the Company, the Company clearly indicates in advance the purposes for which the Personal Information is intended to be used. The Company uses the provided Personal Information within the scope of the stated purposes of use. When there arises a need to use the Personal Information for any purpose that goes beyond the stated purpose of use, the Company notifies the individual to whom the Personal Information refers to that effect and obtains the individual’s consent before using the information for such purpose. The Company uses the Personal Information which are contracted from other companies within the scope of the contract with such company.

4. Provision of Personal Information

1. The Company does not disclose to third parties the Personal Information obtained from customers, suppliers and officers/employees of the Company, except in the following cases:

1. When the individual has given a prior consent to the disclosure;
2. When the disclosure is necessary to respond to an emergency that threatens the life, health or safety of the Individual or another individual;
3. When the Company consigns the handling of the Personal Information to a third party within the scope necessary to achieve the purpose of intended use;
4. When another entity succeeds the business of the Company due to an amalgamation, business transfer or otherwise; or
5. Under other requirements by the laws and regulations.

2. When it is deemed that an inquiry or request from a customer concerning products, repairs, or service can be more appropriately dealt with by an affiliate or distributor of the Company, we may provide the customer‘s name, address, telephone number and other information to the affiliate or distributor.

5. Requests for Disclosure, etc. of Personal Information

The Company complies with the following requests from customers, suppliers and officers/employees of the Company, concerning the Personal Information of himself/herself held by the Company, for: 1) its Disclosure; 2) the Notification of the purpose of use for which the Personal Information has been used during the period of one (1) year from such request for notification; 3) its Correction; 4) Addition to the Personal Information; and 5) Cessation of its use or disclosure to third parties. Please refer to Procedures Concerning Requests for Disclosure etc. for details of request procedures.

In any of the following events, the Company will not comply with the requests for Disclosure, etc. from the individual to whom the Personal Information refers.  When the Company decides not to comply with such request, the Company shall notify the individual in writing or via e-mail to that effect as well as the reason therefor.

1. When the Individual’s identity cannot be confirmed, such as when the address on the document sent by post or in the descriptions in e-mail, the address on the document for confirming the identity of the individual to whom the Personal Information refers, and the address registered at the Company do not match;
2. When there is a deficiency in the prescribed items of description or the document for confirming the identity of the Individual;
3. When the Company cannot identity the Personal Information it holds on the basis of the information contained in the document sent by post or in the descriptions in e-mail;
4. When the Personal Information concerning which the request for Disclosure, etc. is made, falls under any of the followings:
   1) opinion data kept solely for the purpose of evaluating the officers/employees of the Company;or
   2) personal data which is subject to legal privileges.
5. When a request for Disclosure of the Personal Information or Notification of the Purpose of Use of the Personal Information, falls under any of the followings:
   1) if the request unreasonably interferes with the business operations of the Company, considering its frequency or contents;
   2) if the burden or expense for the Disclosure to the Individual of the Personal Information or Providing the Individual the Notification of the Purpose of Use of the Personal Information, is unreasonably large or not balanced with the benefit for the Individual out of such disclosure or notification
   3) if it is requesting for information that is trivial;
   4) If it threatens the safety or physical or mental health of a person other than the Individual;
   5) If it causes immediate or grave harm to the safety or to the physical or mental health of the Individual;
   6) If it leads to revealing the Personal Information about another person, in addition to the Personal Information about the Individual;
   7) If it leads to revealing the identity of a person who has provided the Personal Information about another person and such person providing the Personal Information does not consent to the disclosure of his identity; or
   8) any occasion to be in a breach of other laws and regulations.
6. When the Company judges based upon reasonable grounds that the correction of an error or omission in the Personal Information is not necessary; or
7. any other occasion where it is permitted by laws and regulations not to follow such request for disclosure or notification.

When the Company ceases the use or disclosure to third parties of the Personal Information upon request from the Individual, it may lead to a situation, as a case may be, where the Company cannot supply products or services or maintain the contractual relationship between the Individual and the Company.  On such an occasion, it shall be deemed to be a breach of agreement by the Individual so requested, and the Company reserves any and all rights and claims the Company is entitled under the contract, laws and equity.

6. Contact Window for Requests and Inquiries Concerning Personal Information

Requests for Disclosure, etc. of the Personal Information and any other inquiries or complaints concerning the Personal Information shall be directed to the contact window as follows:

7. Request to Customers under 21 Years of Age

When customers under 21 years of age provide their Personal Information to the Company, they should provide such Personal Information only after obtaining the consent of a parent or guardian.

 

The Company intends to collect and use the Personal Information for the following purposes:

5. Issuance of warranty cards and provision of after-sales service under warranty
6. Provision of membership services
7. Product development, questionnaire surveys, implementation of product and service monitoring programs
8. Execution of contracts
9. Business negotiations or meetings with customers

2. Personal Information Contracted from Business Partners

Execution of agreement on contracted operations

3. Personal Information of Applicants for Employment at The Company

1. Provision of recruitment information to and communication with applicants for employment (including internships)
2. Management of employment-related data at the Company

4. Personal Information of Officers/Employees of The Company

1. Evaluative Purposes – such as determination on suitability, eligibility or qualification of individuals for employment, appointment to office, promotion or continuance in employment or office and/or removal from employment or office.
2. Management or Termination of an Employment Relationship – such as payroll processing, benefits administration, employee records management, Taxation and social security contribution management, talent management, career development, employee complaints/misconduct investigation, emergency communication.
3. IT infrastructure system management – such as access control, computer network resource monitoring

Personal Information with respect to the above (2) will not be object of disclosure, in principle.

 

A request for Disclosure, etc. of the Personal Information shall be made by the Individual to whom the Personal Information refers, by submitting a document by post or by sending an e-mail, with the following descriptions and along with the document for confirming the identity of the Individual. When posting the documents to the Company, please use registered mail which certifies the confirmation of delivery.

1. Items of Description
   (1) Person Making a Request (Person to whom the Personal Information Refers)
   Name, Mailing address, Telephone number (accessible during the day), E-mail address
   (2) Classification of Request
   Disclosure of the Personal Information; Notification of the Purpose of Use for which the Personal Information has been Used during the Period of One (1) Year from such Request for Notification; Correction of the Personal Information; 4) Addition to the Personal Information; and Cessation of Use or Disclosure to Third Parties of the Personal Information
   (3) Details of Request and its Reason
   (4) How You Provided Your Personal Information, and Name of Relates Products or Services, Inquiry Number
   (5) Contact by the Company to the Individual
   Name of Related Products or Services;
   Receive direct mails; Receive e-mails; Receive telephone calls; Receive visits; Others
2. Document for Confirming the Identity of the Individual
   A copy of any of the following cards or documents:
   (1) National Registration Identity Card/ Employment Pass/ Work Permit
   (2) Driver’s License
   (3) Passport

The Company will handle the Personal Information obtained in connection with the Requests for Disclosure, etc. only for the purpose of complying with such requests.

The Company will not return the submitted documents. After the reply to a request for Disclosure, etc. of the Personal Information has been completed, the Company will either maintains or dispose of the documents in an appropriate manner.

With regard to a request for Disclosure, etc. of the Personal Information, the Company shall comply with the request within thirty (30) days of such request, in principle.  If the Company is unable to comply with the request within thirty (30) days of such request, the Company shall inform the Individual in writing or via e-mail, within thirty (30) days of such request, the timing when the Company can comply with the request.
